These terms and conditions apply to all landscaping, maintenance, and exterior cleaning services provided by Procut Landscapes, a landscaping company operating within Scotland. By requesting a quote, booking a service, or allowing us to commence work, you agree to be bound by these terms. Please read them carefully before instructing us.
Definitions
In these terms, “the Company” means Procut Landscapes. “The Customer” means the homeowner, tenant, or property owner requesting services. “The Contract” means the agreement between the Company and the Customer for the provision of services. “Work” means any landscaping, fencing, decking, paving, drainage, turfing, hedge management, tree surgery, garden design, pressure washing, exterior cleaning, fence spraying, decking spraying, exterior painting, or groundworks carried out by the Company.
Quotes and Estimates
All quotes provided by Procut Landscapes are valid for thirty days from the date of issue. Quotes are based on the information provided by the Customer at the time of survey. If the scope of work changes, or if hidden issues are discovered during preparation (such as poor ground conditions, buried waste, or asbestos), the Company reserves the right to adjust the quote. Any adjusted quote will be discussed with the Customer before additional work begins.
Acceptance and Contract Formation
A contract between Procut Landscapes and the Customer comes into existence when the Customer accepts a written quote, either by email, text message, or signed document. Verbal agreements are not binding until confirmed in writing. The Customer should keep a copy of the accepted quote and these terms for their records.
Payment Terms
Payment terms are clearly stated on each quote. For projects under five hundred pounds, full payment is due upon completion of the work. For projects over five hundred pounds, a deposit of thirty percent is required before work commences. The remaining balance is due within seven days of completion. Payment can be made by bank transfer, cash, or card. Late payments may incur interest at four percent above the Bank of England base rate per annum.
Cancellation and Refunds
The Customer may cancel a booked service up to 48 hours before the scheduled start date without charge. Cancellations made within 48 hours may incur a fee of up to fifty percent of the quoted amount to cover lost booking time and material restocking. Once work has commenced, the Customer does not have the right to cancel. Refunds for partially completed work will be assessed fairly based on materials used and labour already performed.
Access and Site Conditions
The Customer must provide safe and unobstructed access to the work area. This includes clear pathways, unlocked gates, and notification of any hidden hazards such as underground cables, water pipes, or septic tanks. Procut Landscapes is not liable for delays or additional costs caused by lack of access or undisclosed site hazards. The Customer should also inform us of any fragile surfaces, young lawns, or delicate plants that need protection.
Weather and Delays
Landscaping work is weather dependent. Heavy rain, snow, ice, or high winds may cause delays. Procut Landscapes will reschedule affected work as soon as conditions allow. The Company is not liable for consequential losses caused by weather related delays. We will communicate promptly with the Customer about any changes to the planned schedule.
Materials and Waste Removal
All materials supplied by Procut Landscapes remain the property of the Company until paid for in full. Waste removal is included in most quotes unless stated otherwise. Green waste, soil, rubble, and old timber will be taken away and disposed of responsibly at licensed facilities. The Customer should not add their own waste to our collection vehicles. Hazardous materials such as asbestos, chemicals, or oil tanks are not accepted and must be removed by a specialist contractor before we begin work.
Tree Surgery and Dangerous Work
Tree surgery is inherently dangerous. Procut Landscapes holds full public liability insurance and all tree surgeons hold NPTC qualifications. The Customer must inform us of any Tree Preservation Orders (TPOs) or Conservation Area restrictions affecting their property before work begins. Obtaining necessary permissions from the local council is the responsibility of the Customer. Work carried out without required permissions is done at the Customer’s own risk.
Property Damage and Liability
Procut Landscapes takes great care to protect your property during work. However, accidents can happen. The Company will repair any damage caused directly by our negligence. We are not liable for pre-existing issues such as unstable walls, rotting fences, or tree roots affecting foundations that become apparent during work. We recommend that Customers move valuable plants, garden ornaments, and outdoor furniture before we arrive.
Complaints Procedure
If the Customer is not satisfied with any aspect of our work, they should contact us within seven days of completion. We will arrange a site visit to review the issue. Reasonable rectification work will be carried out at no additional cost. If agreement cannot be reached, the Customer may refer the matter to a certified third party mediator. Legal action should only be taken after mediation has been attempted.
Data Protection
Procut Landscapes collects and stores Customer names, addresses, phone numbers, email addresses, and project details solely for the purpose of providing services. We do not share Customer data with third parties for marketing purposes. Customers may request access to their data or request deletion by emailing us. We comply with UK General Data Protection Regulation (UK GDPR) requirements.
Health and Safety
Procut Landscapes operates under the Health and Safety at Work etc Act 1974. Our team uses appropriate personal protective equipment (PPE) at all times. The Customer should keep children, pets, and other family members away from active work areas. We will display warning signs where needed. If the Customer wishes to remain on site during work, they must follow any safety instructions given by our team.
Governing Law
These terms and conditions are governed by the laws of Scotland. Any disputes arising from the contract shall be subject to the exclusive jurisdiction of the Scottish courts. This does not affect the Customer’s statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Changes to These Terms
Procut Landscapes may update these terms and conditions from time to time. The latest version will always be available on our website. For existing contracts, the terms in force at the time of quote acceptance will apply.
